GBOB.com terms of use agreement

We apologise for the tedious length of this Agreement. Unfortunately, all this is necessary in order for GBOB.com to provide online interactive services where both your rights and GBOB’s rights are established and legally protected.

1. DESCRIPTION OF SERVICES

GBOB.com is a networking service for those interested or actively involved in performing, creating and/or listening to music and interacting with like-minded individuals. It allows registered Members to create personalised profiles, present music composed and/or played by themselves, listen and recommend other musical content, and communicate with friends and/or musical colleagues (the “GBOB Services"). The GBOB Services include the GBOB.com website and all features, applications and content offered by GBOB.com in connection with the GBOB Website. The GBOB Services are owned and administered by GBOB International of 21 Denmark Street, London WC2H 8NA, United Kingdom.

2. YOUR ACCEPTANCE

This Terms of Use Agreement ("Agreement") sets out the legally binding terms governing your use of the GBOB Services. By accessing or using the GBOB Services, you (the “User") accept and agree to be bound by this Agreement whether or not you are a registered member of GBOB.com. If you do not agree with any of the terms and conditions in this Agreement, you should stop using the GBOB Services immediately.

GBOB.com reserves the right to modify parts of this Agreement at any time without prior notice. If we make such modifications we will email registered members informing them of the changes. We will also post the modifications to the Agreement on this page and show at the top of the page the date these terms were updated. If any modification is unacceptable to you, you should stop using the GBOB Services immediately. Continuing to use the GBOB Services after such changes indicates your full acceptance of the modifications.

This Agreement includes GBOB.com’s rules for acceptable use of the GBOB Services, your rights, obligations and constraints regarding your use of the GBOB Services and GBOB.com’s Privacy Policy.

3. ELIGIBILITY AND REGISTRATION

You must be 13 years of age or older to use the GBOB Services. By registering with the GBOB Services, you represent and warrant that you are 13 years of age or older. You further represent and warrant that: (a) all registration information you submit is truthful and accurate; (b) you will maintain and update the personal information to keep it accurate and complete; (c) you will be solely responsible for any and all use of your account and all activities taking place under your username. (d) you will keep your password secure; (e) you agree to notify GBOB.com immediately if you believe that there has been any unauthorised use of your account or your password.

GBOB.com may refuse, at its sole discretion, to allow you a username that is protected by trademark, impersonates another person, company or organisation, or that is obscene, offensive or otherwise inappropriate. GBOB.com may delete your profile and terminate your membership at any time without warning if you violate any of the terms of this Agreement.

4. USER CONTENT AND CONTENT CONTROL

The GBOB Services are made available to you for your personal, non-commercial use only. You are not allowed to use the service for any illegal or unauthorised purpose. All Users agree to abide by all relevant local, national and international laws and regulations pertaining to online behaviour and acceptable content. You, the User, are solely responsible for all activity on your account as well as all text, data, information, graphic, photographs, audio and video files, links and other materials (hereafter referred to as “Content") that you submit, post and display on or through the GBOB Services.

GBOB.com may, but is not obliged to, remove any Content that we consider, at our sole discretion, to be unlawful, infringes any intellectual property or proprietary rights, or that is obscene, offensive or otherwise inappropriate. GBOB.com is under no obligation to check the accuracy or appropriateness of User content, nor is GBOB.com under any obligation to monitor the User’s content and activities within the GBOB Services.

5. CONDITIONS OF USE

You agree to abide by all applicable local, national and international laws and are solely responsible for Content on your account when using the GBOB Services. The following is a partial list that includes, but is not limited to, the kind of Content that is illegal or prohibited to post on or through the GBOB Services. You agree not to post Content that, at the sole discretion of GBOB.com:

promotes or incites racism, bigotry, hatred or physical harm of any kind toward or against any group or individual;

is abusive, obscene, defamatory or libelous;

harasses or advocates harassment of another person or violates the rights (such as rights of privacy and publicity) of others;

exploits people in a sexual or violent manner;

includes materials that falsely imply that such materials are endorsed or sponsored by GBOB;

contains nudity, violence, or offensive subject matter or contains a link to a website displaying such content;

promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;

solicits passwords or personal identifying information from other Users;

provides any personal information including telephone numbers, street addresses, last names, URLs or email addresses;

promotes an illegal or unauthorized copy of another person’s copyrighted work;

involves the transmission of “junk mail,” “chain letters,” unsolicited mass mailing, pyramid schemes, instant messaging, or “spam”;

contains restricted or password-only access pages or hidden pages or images (those not linked to or from another accessible page);

promotes criminal activity or provides instructional information about illegal activities;

involves commercial activities and/or sales without GBOB.com’s prior written consent;

includes a photograph of another person posted without that person’s consent;

uses sexually suggestive imagery or any other misleading Content intended to draw traffic to the profile.

Here follows a partial list of activities that are illegal or prohibited on the GBOB Website and through your use of the GBOB Services. GBOB.com reserves the right to take appropriate legal action against anyone who, at GBOB.com’s sole discretion, engages in such activities, including reporting you to law enforcement authorities. Prohibited activities include, but are not limited to:

advocating or encouraging criminal activity of any kind;

advertising to, or solicitation of, any Member to buy or sell products or services through the GBOB Services;

displaying an advertisement on your profile, or accepting payment or payment in kind in exchange for your performing any commercial activity on or through the GBOB Services on behalf of a third party;

covering or obscuring any banner advertisements on your personal profile page, or any GBOB.com page using HTML/CSS or any other means;

Removing any copyright or trademark notices contained on the GBOB Services;

Implementing any automated abuse of the system, including but not limited to, using scripts to add friends or send comments or messages;

interfering with or disrupting the GBOB Services or the networks or services connected to the GBOB Services;

attempting to impersonate another User or person;

using the account, username, or password of another User at any time or revealing your password to any third party or permitting any third party to access your account;

using any information obtained from the GBOB Services in order to harass, abuse, or otherwise harm another person;

using the GBOB Services in any manner that violates any applicable laws and regulations;

6. TERM AND TERMINATION OF AGREEMENT

This Agreement shall remain in force for as long as you use the GBOB Services or are a Member. You may terminate your Membership at any time. GBOB.com can terminate your Membership at any time without notice. This Agreement will remain in force even after Membership is terminated.

7. PROPRIETARY RIGHTS

GBOB.com does not claim any ownership rights in any Content that you submit, post or display on or through the GBOB Services. After posting the Content on or through the GBOB Services you retain all ownership rights in such Content as well as the right to use your Content in any way you choose. However, by submitting, posting or displaying any Content on or through the GBOB Services, you hereby grant GBOB.com a limited licence to use, modify, publicly perform, publicly display, reproduce and distribute such content on and through the GBOB Services.

Without this limited licence, GBOB.com would not be able to provide the GBOB Services. For example: without the right to modify your Content, GBOB.com would not be able to digitally compress music files or otherwise format Content to meet technical requirements. And without the right to publicly perform Content, GBOB.com would not be able to allow other Members and Users to listen to your music.

This limited licence is non-exclusive (meaning you retain the right to licence the same Content to anyone else in addition to GBOB.com); fully paid and royalty-free (meaning that GBOB.com is not required to pay you or anybody else for the use of your Content on or through the GBOB Services); sub-licensable (so that GBOB.com can authorise its affiliates and sub-contractors – such as internet and WAP delivery networks – to provide the GBOB Services); and worldwide (because the internet and the GBOB Services can be accessed worldwide). This licence terminates as soon as you remove your content from the GBOB Service. This licence does not give GBOB.com the right to sell your Content, nor does it give GBOB.com the right to distribute your Content outside the GBOB Services.

You represent and warrant that: (a) you own the Content you post on or through the GBOB Services or otherwise have the right to grant the licence set forth in this Agreement; and (b) the posting of your Content through the GBOB Services does not violate the privacy rights, publicity rights, intellectual property rights, copyrights or contract rights of any person. You agree to pay all royalties, fees and other monies found to be owing to any person as a result of any content posted by you on or through the GBOB Services.

In consideration of this, GBOB.com grants you a limited, revocable, non-sub licensable licence to reproduce and display the GBOB.com and GBOB Services content (excluding software code) solely for your personal use in connection with viewing and using GBOB.com and the GBOB Services.
GBOB.com and its affiliates and licensors own and retain all rights in the GBOB.com Website and the GBOB Services which contain proprietary and confidential information that is protected by intellectual property and other laws. The GBOB Services contain Content of Users and other GBOB.com licensors. With the exception of Content posted by you, you are not allowed to copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content found on or through the GBOB Services.

8. PRIVACY POLICY

The use of GBOB Services is governed by GBOB’s Privacy Policy, which by this reference is incorporated into this agreement. To read GBOB’s Privacy Policy click here.

9. COPYRIGHT POLICY

You may not post, modify, distribute, or reproduce in any way any copyright material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is GBOB.com’s policy to terminate any User’s access to the GBOB Services upon receipt of proper notification to GBOB.com by the copyright owner or the copyright owner’s legal representative. If you believe that your work has been copied and posted on the GBOB Services in a way that constitutes copyright infringement, please file a copyright infringement notification notice (Notice) to us. This Notice should include the following information: (a) a description of the copyrighted work you claim has been infringed; (b) a description of the way in which the copyright has been infringed; (c) the location on the GBOB.com website of the alleged infringement; (d) an electronic (scanned) or physical signature of the person authorized to act on behalf of the copyright owner; (e) your address, telephone number, and email address; (f) a written statement by you that you believe in good faith that the alleged use is not authorized by the copyright owner, its agent, or the law; (g) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. 10. LIMITATION OF LIABILITY

Your use of the GBOB Services is entirely at your own risk. Under no circumstances will GBOB, its parents, subsidiaries and affiliates, and their respective owners, officers, managers, agents and employees, be liable to you or any third party for any damages or losses arising out of or in connection with the use of the GBOB Services.

11. DISCLAIMER OF WARRANTIES

GBOB.com is not responsible for any incorrect or inaccurate Content posted in connection with the GBOB Services, whether posted by Users of the GBOB Services or by any of the equipment or programming associated with or utilised in the GBOB Services. Profiles created and posted by Members on the GBOB Website may contain links to other websites. GBOB.com is not responsible for the Content, accuracy, legality or opinions expressed on such websites, and such websites are not investigated, monitored or checked for accuracy by GBOB.com. Inclusion of any linked website on the GBOB Services does not imply approval or endorsement by GBOB.com. GBOB.com accepts no responsibility for third party advertisements which are posted on or through the GBOB Services, nor does it accept any responsibility for the goods or services provided by its advertisers.

GBOB.com is not responsible for the conduct of any User of the GBOB Services. GBOB.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. GBOB.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems or traffic congestion on the Internet or on any of the GBOB Services or combination thereof, including any injury or damage to Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the GBOB Services.

GBOB.com is not responsible for any loss or damage, including personal injury or death, resulting from use of the GBOB Services, attendance at a GBOB.com event, from any Content posted on or through the GBOB Services, or from the conduct of any Users of the GBOB Services.
The GBOB Services are provided as available. GBOB.com cannot and does not guarantee any specific results from use of the GBOB Services. The Disclaimer of Warranties does not affect your right to remove your profile from the GBOB Services.

12. MEMBER DISPUTES

Your interaction with other GBOB.com Members is your sole responsibility. GBOB.com reserves the right, but is not obliged, to monitor disputes between Members.

13. ACCEPTANCE OF TERMS

These Terms of Use will be governed in accordance with the laws of the United Kingdom and constitute the entire agreement between you and GBOB.com. This Agreement is accepted upon your use of the GBOB.com Website or the GBOB Services and further confirmed by you becoming a Member of GBOB.com.
